What Is “Straight Time” Pay?

Employers sometimes pay their workers “straight time,” meaning the employees are paid the same hourly rate for every hour worked. If the company does not pay 1 1/2 times the employee’s regular rate or hourly rate, and the employee is not exempt under the Fair Labor Standards Act (FLSA) guidelines, a lawsuit may be filed to recover unpaid overtime.

FLSA sets the standards for wages and overtime guidelines employers must comply with when paying their employees. An employer can require their workers to work any number of hours. FLSA does not limit the number of hours or days a worker may work. However, FLSA laws require employers to compensate their nonexempt hourly employees who work more than 40 hours per week at a rate equal to 1 1/2 times their regular rate of pay.
